Purchase of Inherently Dangerous Tools

To purchase daggers or any other pointed inherently dangerous tool from American New Defense you are required to read, understand and agree to the following sales agreement before purchase.

G-10 Daggers sold by American New Defense are not legal for sale in the state of California, Delaware or New York.

-Sales Agreement:

By placing an order, clicking "purchase," or otherwise acquiring any G-10 dagger from American New Defense LLC ("Seller"), you (the "Buyer" or "Customer") represent, warrant, and agree to the following:

Age and Legal Capacity: You are at least 18 years of age (or 21 in jurisdictions requiring it) and have full legal capacity to enter into this agreement. Seller does not sell to minors. You warrant that you are legally permitted to purchase, own, possess, and (if applicable) display these items in your jurisdiction.

Compliance with All Laws: It is solely your responsibility to ascertain, understand, and comply with all applicable federal, state, local, and international laws, regulations, and ordinances regarding the purchase, ownership, possession, display, transport, carry, use, or modification of these items (including but not limited to knife/dagger laws, concealed weapons statutes, prohibited items lists, and export/import restrictions). Seller cannot and does not provide legal advice. Verify legality in your area before ordering.

Inherent Risks and Assumption of Risk: You acknowledge that G-10 daggers are sharp, pointed, inherently dangerous tools capable of causing serious personal injury, disfigurement, property damage, or death if mishandled, misused, or defective. You voluntarily assume all risks associated with ownership, possession, display, handling, use, or misuse of these items, including risks from defects, accidents, improper storage, or third-party actions—even if allegedly caused by Seller's negligence.

Release and Waiver of Liability: To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue Seller, its owners, officers, employees, agents, affiliates, successors, and assigns from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, or expenses (including attorney fees) arising from or related to the purchase, ownership, possession, display, use, misuse, modification, or failure of these items, including but not limited to personal injury, death, or property damage.

Indemnification and Hold Harmless: You agree to indemnify, defend, and hold harmless Seller from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) brought by you, your heirs, assigns, or any third party arising from or related to your ownership, possession, use, misuse, modification, or transfer of these items, or any violation of law by you.

No Intended Use as Weapon / Prohibitions: These items are not to be used as weapons, for self-defense, in the commission of any crime, or in any manner that could cause bodily harm or property damage. You agree not to alter, modify, or misuse them. Seller disclaims all liability for any such use.

No Warranties: All items are sold "AS IS" with no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Seller makes no representations about safety, legality, or performance.

Severability and Governing Law: If any provision is unenforceable, the remainder remains in effect. This agreement is governed by Florida law, without regard to conflict-of-laws principles.

By completing your purchase, you confirm you have read, understood, and agreed to this entire agreement. No purchase will be processed without this acceptance.
